Background

Overview

This concept is central to understanding the functioning of India's democratic system, the checks and balances between different organs of the state, and the protection of fundamental rights. It is a recurring theme in GS2.

Judicial review is a fundamental feature of the Indian Constitution, empowering the Supreme Court and High Courts to examine the constitutionality of legislative enactments and executive orders. Statutory interpretation, a subset of judicial review, involves the judiciary determining the meaning and application of laws passed by the legislature.

Separation of Powers

This power is exercised within the framework of separation of powers, acting as a check on the legislative and executive branches.

Precedent (Stare Decisis)

Supreme Court judgments set precedents that guide lower courts and future interpretations, though larger benches can overturn previous rulings.

Basic Structure Doctrine

Judicial review forms part of the basic structure of the Constitution (Kesavananda Bharati case).

Function of Judicial Review

Allows courts to strike down laws or executive actions that violate the Constitution or exceed legislative competence.

Principles of Interpretation

Statutory interpretation involves applying principles like the literal rule, golden rule, mischief rule, and purposive approach.

Purpose

Ensures the rule of law, protects fundamental rights, and maintains checks and balances within the government.
